Below is a copy of the Litigation Funding Agreement that has been executed by the Litigation Funder and the Lead Applicants.
In summary, this agreement states:-
- that in the event that the Applicant is unsuccessful, Dr McCann (the Funder) will be liable for all legal and other costs;
- that in the event that the Applicant is successful, the Group Members may be required to reimburse Dr McCann; and
- Dr McCann will not receive any percentage of the Group Members’ compensation beyond the sum required to reimburse her for the legal costs she has borne as Funder.
